Babu Owino Taken Back to Court

Embakasi East Member of Parliament, Babu Owino, is scheduled to appear in court on Tuesday to request the return of his firearm, following his acquittal in a case involving the alleged misuse of the weapon. 

The case is related to the shooting of Felix Orinda, popularly known as DJ Evolve, who survived a neck injury at a nightclub in Kilimani, Nairobi County, in 2020.

Authorities had confiscated Babu Owino’s firearm during the course of their investigations into the incident.

During the case, DJ Evolve testified virtually, stating that he had no recollection of the events that transpired on the night of the shooting. 

He explained that he only became aware of his situation when he found himself in an ambulance. 

Notably, DJ Evolve also mentioned that he did not see Babu Owino with a gun that night and had no knowledge of the firearm that had caused his injury.

In response, Babu Owino made a commitment to support DJ Evolve throughout the ordeal. He not only covered DJ Evolve’s hospital expenses but also provided him with financial assistance for his daily needs.

The second witness, who was Babu Owino’s security guard, testified that the Member of Parliament did not use his firearm on the day of the incident. 

Instead, he clarified that Babu Owino had taken the gun for maintenance and inspection because it had experienced a jam, indicating that there was no intention to use it in a harmful manner that night.

Babu Owino was acquitted on August 29 after the Magistrate Court  ruled that the prosecution had failed to provide sufficient evidence to prove Babu Owino’s guilt beyond a reasonable doubt. 

Trial Magistrate Bernard Ochoi observed that the prosecution had not proved that the gunshot was fired from Babu Owino’s gun. He also observed that the prosecution had failed to prove that Babu Owino was under the influence on that particular day.

“Samples taken don’t show that the investigating officer desired to know the alcoholic content in babus blood.”

As a result, Babu Owino was set free, and the charges of attempted murder against him were withdrawn.

“This judgment has gone the way the almighty God wanted it to go. That is how God wanted it to go,” Babu said after his acquittal.
