OCS Arrested Trying to Help Prisoners Escape

Ruai OCS Duncan Otieng was apprehended by the Ethics and Anti-Corruption Commission (EACC) for accepting bribes to expedite the release of four detained partygoers. EACC revealed that the OCS was ensnared in their anti-corruption operation after being lured into accepting the illicit funds.

Otieng had initially insisted on receiving Ksh3,000 as a precondition to facilitate the release of the individuals, who had been previously apprehended on charges of public intoxication and disorderly conduct.

“Police officers from EACC Nairobi arrested the OCS on the allegation that he had received Ksh3,000 treated money in order to secure the release of four prisoners who were arrested on Friday, November 3,” a police statement read in part. 

According to police officers, the OCS was nabbed before he could facilitate the prisoners’ release. 

Assuring the public, EACC noted that the four prisoners would face the rule of law despite earlier attempts to evade justice.

“They are in custody and awaiting to be arraigned in court on Monday, November 6,” it was revealed noting that they could not have been prosecuted over the weekend

The OCS who was taken to EACC headquarters at Ardhi House, Nairobi will also face charges of extorting bribes. 

EACC did not give a timeline on when the officer would be arraigned in court noting that the OCS was being held as the anti-corruption body conducted further investigations. 

According to Kenyan law, the officers have 24 hours to present their colleague in court for a guilty plea where he will then be released on cash bail or remanded pending further investigations.

Earlier reports that were not confirmed by the police had indicated that the officer had demanded Ksh5,000 from prisoners.

 total, it had been reported that the OCS collected Ksh25,000 with the promise that he would facilitate the release of the revellers. 

Should the officer be found guilty of bribery, upon conviction he will be liable to a fine of up to Ksh5 million or sentenced to imprisonment for a term not exceeding 10 years, or both.
