Judge Who Suspended Ruto’s Finance ACT Transfered

News just in indicates that the judge who suspended the President William Ruto’s Finance Act 2023 has been transferred immediately as senior Counsel Ahmednasir Abdulahi reacts.

High Court Judge Mugure Thande who had temporarily suspended the Finance Act has been transferred from her work station at the Milimani Constitutional and Human Rights Division to Malindi High Court.

Lady Justice Hedwig Ongudi who was also part of the 3 Judge Bench which had refused to lift the conservatory orders by Justice Thande has also been transferred from Milimani Constitutional Human Rights Division to Nakuru High Court as the Presiding Judge.

Justice David Majanja who is currently leading a 3 judge bench hearing the petition by Busia County Senator Okiya Omtatah on the Finance Act has been moved from Commercial and Tax Division to Civil Division.

These are some of the the 11 changes that has been made by the Chief Justice Martha Koome.

While reacting to this move, Senior Counsel Ahmednasir Abdulahi has alleged that the effective punishment and reward for judges is by their transfer.

“Transfers are the most effective form of punishment and reward for judges Kenya. Justice Thande was OBVIOUSLY transferred to Malindi as punishment for her decision in the Finance Bill. This will have a chilling effect on judicial independence in Kenya. SAD” SC Ahmednasir Abdulahi said.
