Former Deputy President Rigathi Gachagua has withdrawn Constitutional Petition E522 of 2024, which challenged aspects of the impeachment process that led to his removal from office in October 2024.
The petition was among several legal challenges filed following the National Assembly's decision to initiate impeachment proceedings against Gachagua, who became Kenya's first Deputy President to be removed from office through impeachment.
The legal battle arose after Parliament approved his removal over several allegations, including claims of gross violation of the Constitution, undermining the government and promoting ethnic divisions.
Gachagua challenged the process, arguing that his constitutional rights had been violated and that Parliament failed to follow the required legal procedures.
His legal team, led by Senior Counsel Paul Muite, has been involved in several court proceedings seeking to challenge the circumstances surrounding his removal.
The withdrawal of Petition E522 comes against the backdrop of an extensive legal battle that has involved several consolidated petitions before the High Court.
The court's decision highlighted the distinction between the legality of the impeachment and the constitutional rights that must be respected throughout the process.
Gachagua's latest move adds another development to the prolonged legal dispute surrounding his removal from the country's second-highest office.
